          So i`ve received a pretty standard letter from Lowells saying that they have received my complaint (Thanks Niddy for the excellent letter!) and they will be investigating thoroughly.
          So i suppose it`s a waiting game....lets see what they come back with....? As long as they don`t p!ss on my frugal Christmas eh?

          Other than that everything is relatively quiet.... although Vanquis are giving me the phone calls a couple of times a day...but that`s no bother as i don`t answer the phone unless it`s three rings anyway!

          So all okay......thanks for everyone`s help so far

            Just as a matter of interest did you ever try to contact SDG (or their winged monkeys NDR Money), and try to come to a resolution with them before you tried the UE route?

            Reason for my question is that SDG/NDR were very trigger happy in applying charges to their accounts to bump up their value before selling them on to DCA's like Lowells.

            One of the reasons they used to give for these charges was because 'they have been unable to contact you'. If you can demonstrate this is not the case it not only throws into dispute the balance of the account, but also any further interest charges applied, not to mention the unlawful application of charges.

            I have managed to get Lowells to drop a SDG account already on the above argument as it would throw open a tin of worms for them and SDG!

            Just a thought as you have issued a SAR and another angle you can work on with Niddy

              Yes i tried to offer SDG a monthly pro rata repayment, as i offered repayments to my other credit cards too at the same time when i got into financial difficulty but they wouldn`t accept it. I kept writing back to Littlewoods asking for them to reconsider but to no avail. Lots of late payment charges etc were applied to my account before they sold it onto Lowells.

              It is really encouraging to hear your story. I`ll have a look at your diary later when i get a minute.

                Ok thats great as they're on a sticky wicket. The letter you're looking for will say something like this:

                You have failed to make a payment
                I have attempted to contact you on several occasions to discuss the outstanding debt on your account. You have failed to make a payment or to contact us to let us know if you are having financial difficulties. As a result a £12 administration fee has been added to your account.

                If they have sent you that after they have received, and rejected, your payment offer it places them in a difficult position:

                1) If the offer was sent in conjunction with an I&E sheet that complied with the CFS format this is in breach of OFT guidelines

                2) If they have written to you rejecting your offer, and then sent the letter above, they contradict themselves in their statement that you have failed to inform them of financial difficulty which is going to look bad for them in court.

                Its common tactic for SDG to refuse to accept payment offers, and then apply many unlawful charges before selling on to a DCA.

                See what they send back and then have a look at using this as an extra card to play if necessary........

                  I had lots of correspondence from SDG before they sold the debt on to Lowells so i`ll have to have a good look through all my disorganised paperwork - but what you have quoted above seems rather familiar to me.

                    Me again!!!

                    I`ve updated my diary and just wondered if i`m doing the right thing?

                    Aqua have sent me a letter asking me to settle the account or ring them to discuss a repayment plan. I still haven`t received my CCA so it`s in dispute now so i`m going to ignore them and see what they send next. Is that the right thing to do?

                    Moorcroft have asked me to settle or come to an arrangement regarding my Vanquis account. Now this one is so i`m thinking of offering them £1.00 and see if they accept. So shall i offer it them now, or wait and see if Vanquis get in touch again as the letter from Moorcroft does not state that they have bought the debt - just that they have been instructed by Vanquis to collect the debt.

                    Mercers are passing my account to a specialist collections company and they may send a representative round to discuss my debt. I`m thinking of ignoring this too and seeing what happens as this is - is that right? Or shall i send them the letter to stop doorstep visits or something?

                    Any help greatly appreciated - i`m off to the little ones Christmas play but will be on again later.

                      If you can tell me why it's ue we can point you in the right direction with a suitable letter

                      with regard to the Vanquis card, if this is the first you've heard from Moorcroft send them a sold in dispute http://www.all-about-debt.co.uk/old/...lst-in-dispute make sure you edit to suit

                        Barclaycard/Mercers is UE because the prescribed terms are not complete. I sent the cca query letter to Barclaycard and now Mercers have been in touch saying they will be passing my account to a specialist collections company. So shall i send the account in dispute to Mercers?


                        Unfortunately the Vanquis/Moorcroft one is Enforceable so i`m not quite sure what to do about this one.......shall i just see what they send next?

                              Can i just ask a quick question?

                              The Moorcroft one is Enforceable as Vanquis sent me the CCA and Niddy had a look at it for me, so it isn`t in dispute....sorry i think i may have confused things.......Aqua is in dispute, but Moorcroft isn`t, so i dont know what my next steps will be with Moorcroft....?

                                HAPPY NEW YEAR EVERYONE!!!

                                LOWELLS UPDATE!!!

                                I received a letter from Lowells over the Christmas hols replying to the excellent letter that Niddy wrote for me and guess what?????

                                They have apologised for any distress they may have caused me and closed my account!!!!

                                This is my first success since joining this excellent helpful forum and i really am sooooo chuffed!

                                I want to thank everyone for all their advice so far and Niddy !!!!!!
